By accessing or using FishGuidePro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update or modify these Terms at any time. Material changes will be communicated via email, in-app notice, or website posting. Continued use after changes constitutes acceptance.
2. Description of Service
FishGuidePro is a mobile-first web application that provides anglers with:
- Interactive lake maps with bathymetry data
- Waypoint and fishing catch logging capabilities
- Weather and fishing condition information
- Species-specific fishing guidance and hotspot recommendations
- Premium features through paid subscriptions
2.1 Service Availability
We may add, modify, suspend, or discontinue features or services at any time without liability. Uptime is not guaranteed.
3. User Accounts
3.1 Account Creation
- You must create an account using Firebase Authentication
- You must provide accurate and complete information
- You are responsible for maintaining account security
- You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with parental/guardian consent.
3.2 Account Responsibilities
- You are solely responsible for all activity under your account
- You must notify us immediately of unauthorized use
- You may not share your account credentials
- You may not create multiple accounts to circumvent usage limits
4. User Content and Data
4.1 Content You Provide
You may submit content including:
- Fishing catch records and photos
- Waypoint locations and notes
- User preferences and settings
- Feedback and communications
4.2 Content License
By submitting content, you grant FishGuidePro:
- A worldwide, non-exclusive, royalty-free license to use, modify, and display your content
- Permission to use your data to improve the Service, including but not limited to:
- Enhancing fishing hotspot algorithms
- Improving species identification and recommendations
- Analyzing fishing patterns and seasonal trends
- Developing new features and functionality
- Providing personalized recommendations to all users
4.3 Promotional Use
We may use anonymized or aggregated catch records, waypoints, or photos for marketing or promotional purposes.
4.4 Content Standards
You agree not to submit content that:
- Violates laws or regulations
- Infringes on intellectual property rights
- Contains malicious software or code
- Includes personal information of others without consent
- Is false, misleading, or deceptive
4.5 Retention After Termination
We may retain your submitted content for a limited period after account termination as required by law or for legitimate business purposes, after which it will be deleted or anonymized.
5. Permitted and Prohibited Uses
5.1 Permitted Uses
- Personal, non-commercial use of the Service
- Logging your own fishing activities and locations
- Sharing fishing spots and catches through the Service's features
5.2 Prohibited Uses
- Commercial use without written permission
- Automated data collection or scraping
- Reverse engineering or attempting to access source code
- Interfering with Service operations or security
- Violating any applicable laws or regulations
6. Subscriptions and Payments
6.1 Free Service
- Limited to 10 waypoints and 10 catches
- Basic map and hotspot features
6.2 Pro Subscription
- Unlimited waypoints and catches
- Advanced features and priority support
- Processed through Stripe payment processing
6.3 Payment Terms
- Subscriptions automatically renew unless cancelled
- Refunds: Subscriptions are non-refundable except where required by law. Partial refunds or proration for upgrades/downgrades are at our discretion.
- Prices subject to change with notice
7. Intellectual Property
7.1 Our Rights
FishGuidePro retains ownership of:
- The Service software and technology
- Bathymetry and map data compilations
- Aggregated and anonymized user data insights
- Service branding and trademarks
7.2 Third-Party Content
The Service includes third-party content from:
- Mapbox mapping services
- Weather and solunar data providers
- Government bathymetry data
- Firebase (authentication & storage) and Stripe (payment processing)
8. Privacy and Data Use
Your privacy is governed by our Privacy Policy, incorporated into these Terms. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.
8.1 Security
We use industry-standard services (Firebase, Stripe) to store and process sensitive data. We do not store raw payment information.
9. Disclaimers and Limitation of Liability
9.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
9.2 Fishing and Boating Safety
- Fishing and boating activities involve inherent risks
- You are solely responsible for your safety
- Always follow local regulations and safety practices
- Verify all navigation and depth information independently
9.3 Data Accuracy
Maps, bathymetry, weather, solunar data, and hotspot recommendations are provided for informational purposes only. They may be inaccurate or outdated and should not be relied upon as the sole source of navigation or fishing decisions.
9.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PRECEDING 12 MONTHS.
10. Termination
10.1 Your Right to Terminate
You may terminate your account at any time by contacting us or using account deletion features.
10.2 Our Right to Terminate
We may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent or illegal activity
- Extended periods of inactivity
10.3 Effect of Termination
Upon termination:
- Your access to the Service will cease
- Your data may be deleted (subject to legal requirements)
- Pro subscription benefits will end
11. Copyright & DMCA Policy
If you believe content on the Service infringes your copyright, you may file a notice under the Digital Millennium Copyright Act (DMCA). Repeat infringers' accounts may be terminated.
12. General Provisions
12.1 Governing Law
These Terms are governed by the laws of the State of Minnesota, USA, without regard to conflict of law principles.
12.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
12.3 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and FishGuidePro.
